    CHAPTER 11 THE LEGAL WORLD: PRISONERS’ RIGHTS     Chapter Objectives   1.   Explain what is meant by the hands-off doctrine. 2.   Identify the sources of prisoners’ rights. 3.   Recite the central question raised by the concern with the rights for      prisoners. 3.   List the five ways in which inmates can challenge their conditions of      confinement. 4.   Describe the major changes that took place during the prisoner rights era. 5.   List and explain the four amendments to the U.S. Constitution on which      most prisoners’ claims are based. 6.   Explain how the development of rights for female prisoners has differed      from that of the rights of male prisoners.     Chapter Outline   I.      The Hands-Off Doctrine A.      The historical policy of American courts to leave prison administration to operate prisons as they see fit.   B.      Under he separation of powers inherent in the U.S. Constitution, the judicial branch of government should not interfere with the running of correctional facilities by the executive branch.   C.     Correctional administration should be left in the hands of correctional experts.   D.     Decline of the Hands-Off Doctrine 1.      1941, Ex parte Hull began the dismantling of the hands-off doctrine when the court ruled that the prisons could not stop inmates from applying to a federal court for a writ of habeas corpus. 2.      1944, Coffin v. Reichard brought about the decision that inmates did not lose their civil rights when in prison. 3.      Access to the courts was slowly established. 4.      In 1970, the hands-off era ended with the case of Holt v. Sarver , where the entire Arkansas prison system was declared

    detainee slips handcuffs www.mcall.com/news/breaking/mc-bethlehem-handcuffs-sanitizer-dui-20121219,0,1170482.story mcall.com police: man tells officer he broke out of cuffs for hand sanitizer by pamela lehman, of the morning call 9:44 am est, december 19, 2012 advertisement a man arrested for drunken driving in bethlehem on wednesday was able to briefly free himself from handcuffs, telling police it was because he needed a nearby bottle of hand sanitizer. jeffrey barlow, 22, of nazareth, was arrested shortly after 2 a.m. when an officer saw his vehicle without headlights in the area of broad street and stefko avenue. barlow was arrested for drunken driving and was taken to the bethlehem police station for processing. police said barlow was handcuffed and sitting on a bench while officers processed his paperwork. barlow repeatedly struck the handcuffs against the bench and was able to disengage the lock. barlow made it only a few steps away before an alert officer saw the brief escape on a nearby video camera. barlow told the officer "at least let me get some hand sanitizer while i'm up," according to a police report. he was quickly taken into custody and secured to the bench, police said. in addition to drunken driving and traffic summaries, barlow is also charged with escape and criminal mischief. pamela.lehman@mcall.com 610-820-6790   copyright © 2012, the morning call

    As we discussed in class, your final exams are questions taken from the exams that you have had throughout the school year.  I decided to do it this way to ensure you retain what I felt was important when the tests were developed during our respective Chapter review.
     
    I included at the end of your exam an opportunity to express your opinion on what went well this year or anything you would like to see changed for next year.
     
    If you know any future students considering enrolling in the program, please let them know our favorite word used this year.  "ACCOUNTABILITY"  Feel free to explain to them what this term means.
     
    Due to the change in date for the "end of year party" the afternoon class voted to move the final exams up to May 18th. This way they can truly celebrate the end of the year without the final exam looming over them.
